These items are manufactured with blunt edges and lack any sharp or pointed components.

Definitions

1.1. These Terms and Conditions (“Conditions”) govern the use of the eCommerce platform of Malleus Martialis di Rodolfo Tanara (“Seller”) on the website www.malleusmartialis.com (“Online Store”). By accessing or using the Online Store, you agree to comply with these Conditions.

1.2. Definitions

  • Products: Tangible goods sold through the Online Store.
  • User: Any person who accesses or uses the Online Store.
  • Consumer: Any natural person purchasing Products for purposes outside their trade, business, or profession.
  • Business User: Any person purchasing Products for purposes related to their trade or business.
  • Contract: The sales agreement between the Seller and the Consumer or Business User.

Scope

2.1. These Conditions apply to all sales of Products made through the Online Store. If you do not accept these Conditions, you must refrain from using the Online Store.

2.2. The Seller reserves the right to amend these Conditions at any time, with the applicable version being that in effect at the time the order is placed.

Product Characteristics and Availability

3.1. The Online Store offers Products intended for use in sports like Historical European Martial Arts, artistic performance, or for display purposes. By purchasing, the User acknowledges they possess the experience required to safely handle such items.

3.2. All Products are subject to availability and are described on the relevant product pages. Due to artisanal production, actual items may differ slightly from images on the website.

3.3. The Online Store may be accessible worldwide, but Products can only be shipped to countries listed during checkout. For inquiries about shipping to other regions, contact help@malleusmartialis.com.

Product Purchase and Contract Formation

4.1. Orders placed through the Online Store are considered purchase proposals. A Contract is concluded when the Seller confirms the order by email.

4.2. Before completing a purchase, the User must verify their personal details and order contents. Corrections can be made during the checkout process.

4.3. If a Product is unavailable, the Seller will notify the User with options for revised delivery terms or order cancellation.

4.4. The Seller reserves the right to refuse or cancel orders for legitimate reasons, such as suspected fraud or unforeseen logistical constraints.

Prices, Payment, Taxes, Fees and Customs

5.1. Prices shown on the product pages include any applicable packaging costs and indirect taxes but do not include VAT, additional operational fees or shipping fees, which are calculated during checkout.

5.2. For deliveries outside the European Union, Users are responsible for any applicable customs duties or sales taxes, which are not included in the purchase price.

5.3. Payment methods include:

  • Credit Card through Stripe
  • Bank transfer (direct or via Wise)
  • Installment payments (where applicable)
  • Other options as provided at checkout.

5.4. All payments are processed through secure, encrypted connections. The Seller is not responsible for failed payments due to third-party service errors.

Delivery and Shipping

6.1. The Seller endeavors to meet the delivery times indicated on the Online Store but cannot guarantee exact dates due to unforeseen circumstances.

6.2. Delivery costs depend on the User’s location, parcel dimensions, and the shipping method chosen during checkout.

6.3. The User is responsible for verifying the contents of their delivery upon receipt. In case of discrepancies, the User must notify the Seller as soon as possible.

6.4. The Seller is not liable for delays or damages caused by circumstances outside their control, including shipping company errors or force majeure events.

U.S. Import Duties and Tariffs [Updated 2025/09]

7.1. For deliveries to the United States, the prices shown on the Online Store do not include customs duties or tariffs applied by U.S. authorities.

7.2. In accordance with Section 232 of the Trade Expansion Act, products containing steel may be subject to a tariff of 50% on the steel portion of the declared value. As our swords are predominantly made of steel (approx. 90%), this tariff may be applicable.

7.3. In addition, U.S. Customs and Border Protection may apply an import duty of 15% on the full declared value of goods originating from the European Union.

7.4. These charges are determined and collected exclusively by U.S. authorities and are not included in the price or shipping costs indicated by the Seller. The Customer, as the importer of record, is responsible for paying all applicable import duties, tariffs, and taxes in order to receive delivery.

7.5. If the Customer purchases through an authorised U.S. reseller or distributor, the importer of record is the reseller and such charges may already be included in the reseller’s retail price. For direct orders shipped from Italy, however, the Customer is responsible for all import costs as outlined above.

7.6. We provide this information to help you understand potential costs. Import regulations may change, and final charges are always determined by U.S. Customs at the time of entry.

Returns and Refunds

8.1. Consumers have the right to withdraw from a Contract within 30 days of delivery without penalty. To exercise this right, visit the Returns and Refunds page, read carefully and follow the procedure described.

8.2. Products must be returned in their original condition, with all packaging and accessories, at the User’s expense unless otherwise stated. Refunds will be processed within 14 days of receiving the returned goods.

8.3. Custom or bespoke items are excluded from the right of withdrawal, and return requests for such items will not be accepted.

Please note that if you paid using a credit card or PayPal, the payment processor’s transaction fees are not refundable in case of a return.

Unfortunately, these fees are retained by the provider (like Stripe or PayPal) and not returned to us — even when we issue a full refund. This means your refund will cover the item cost, minus the non-refundable transaction fees (usually around 4%).

We always do our best to keep policies clear and fair, and we thank you for your understanding.

Warranty and Liability

9.1. Products are covered by a 24-month conformity warranty for Consumer Users. Business Users are covered by the terms agreed upon during purchase.

9.2. The Seller is not liable for damages resulting from improper use or modifications made to Products by the User or third parties.

9.3. In no case will the Seller’s liability exceed the amount paid by the User for the Product.

Force Majeure

10.1. The Seller is not responsible for failure to meet obligations due to force majeure events, such as natural disasters, strikes, or government regulations.

10.2. The performance of the Contract will be suspended during any force majeure event, and the Seller will strive to mitigate delays as much as possible.

 Intellectual Property

11.1. All content on the Online Store, including text, images, trademarks, and logos, is the intellectual property of the Seller or third parties who have granted permission. Unauthorized use or reproduction is prohibited.

Dispute Resolution and Applicable Law

12.1. For Consumer disputes, the Seller offers an Alternative Dispute Resolution (ADR) process as per Italian law. Information on ADR is available at http://mediazione.infocamere.it.

12.2. These Conditions are governed by Italian law, with disputes to be resolved by the competent court based on the User’s residence or domicile.
